MERMAID MANIA 2019 TAIL GIVEAWAY RULES

PLEASE REVIEW THESE OFFICIAL RULES BEFORE PARTICIPATING IN THE MERMAID MANIA TAIL GIVEAWAY. ENTRANTS WHO ARE MINORS MUST OBTAIN THE CONSENT OF PARENT OR LEGAL GUARDIAN BEFORE ENTERING THE GIVEAWAY. VOID WHERE PROHIBITED BY LAW.

Sponsor: The presenting main sponsor of this giveaway is Blue Spring Partners, LLC, dba Fin Fun (“Fin Fun” or “Sponsor”)

Judge: The presenting judge of this giveaway is Blue Spring Partners, LLC, dba Fin Fun (“Fin Fun” or “Sponsor”)

Begins: June 11, 2019 at 12:01 AM (MT), and ends June 17, 2019 11:59 PM (MT). By entering the event, each entrant agrees to the rules of the giveaway and states that they are at least 18 years of age or has parental or legal guardian consent.

1. Eligibility:

Only those who are over 18 years of age as of June 11, 2019 are eligible for Mermaid Mania prizes. Children aged 13-18 must have permission from a parent or legal guardian to register. Children under 13 must have a parent or legal guardian register for them. The giveaway is only open to legal residents of the United States of America and US territories, and is void where prohibited by law. Employees of Sponsor and their immediate families (spouses, parents, siblings, children and each of their respective spouses), current Fin Fun 2018-2019 Ambassadors, other participating sponsors and each of their respective parent companies, divisions, subsidiaries, affiliates, retailers, distributors, manufacturers, and each of their advertising and promotion agencies (collectively, the “Giveaway Entities”) are not eligible to win. This event is subject to all applicable federal, state and local laws and regulations.

2. Agreement to Rules:

By participating, you agree to be fully unconditionally bound by these rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you accept the decisions of Sponsor, as final and binding as it relates to the giveaway.

3. How to Enter:

Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Sponsor. Only one entry per email allowed. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Sponsor.

4. Requirements:

In order to be entered to win, participants will be required to submit their email address, name, and telephone number.

5. Prizes:

Eight (8) winners will be selected to win a mermaid tail and monofin set of Fin Fun’s choosing.

Prizes are not for resale, nor eligible for exchange or refund. Prize shipment will be sent to winner’s provided address by July 30, 2019.

Approximate retail value is $90 per prize.

Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor. No cash or other prize substitution permitted except at Sponsor’s discretion. The prize is nontransferable. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner.

Acceptance of prize constitutes permission for Sponsor to use winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law, as further defined below.

6. Odds:

The odds of winning depend on the number of eligible entries received.

7. Winner Selection and Notification:

Sponsor will randomly select the winner(s) from eligible participants who have completed the entry form. Winners will be notified via email to the email address entered into the registration form or by telephone on June 18-21, 2019. Sponsor shall have no liability for a winner’s failure to receive notices due to spam filters, junk e-mail restrictions or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible or fails to claim the prize before June 30, 2019, prize may be forfeited, and an alternate winner selected by Sponsor. Mentions of some winners may also be made on social media.

ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

www.finfriends.com/mermaidmania.

8. Rights Granted by You:

By participating in this event you understand that sponsor, anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter established in perpetuity and throughout the world, your entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the event, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation. All materials submitted by you become Sponsor’s property. No materials submitted will be returned to entrant.

9. Terms:

Sponsor reserves the right, at its sole discretion to cancel, terminate, modify or suspend the giveaway should a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the event. In such case, sponsor may randomly select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the event and its activities or website or violates these Terms & Conditions.

Sponsor has the right to take necessary steps, at its sole discretion, to maintain the integrity of the event.

To the extent an entrant uses a third-party site as part of this giveaway, entrant is responsible for knowing and complying with the terms of use and privacy policy associated with such third-party site. Sponsor is not responsible for any content, including links, appearing on any such third-party site. Sponsor is not affiliated with any such third-party sites. The names of such third-party sites may be trademarks and registered trademarks of the respective site owners.

Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the event may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

After the Mermaid Mania giveaway is completed and all prize winners have been selected and verified, Fin Fun will destroy all personal information provided by participants, except for photos as allowed in giveaway rules for promotion, unless the Entrant has indicated they wish to receive future communications, in which case their email address will be added to the Sponsor’s database.

10. Release of Liability:

The Sponsor, its respective affiliates, subsidiaries, parent corporation, Giveaway Administrator, each of the Giveaway Entities, and the dealers, distributors, employees, are not responsible for: any incorrect or inaccurate entry information, human error, technical malfunctions, theft, tampering, destruction, or unauthorized access to, or alteration of entries. By participating in this event, all entrants, any winners and their family members release and hold harmless Sponsor, Sponsor’s Administrator and each of the Giveaway Entities, from and against any and all actions, claims, and/or liability with respect to or in any way arising from participation in this giveaway and/or acceptance or use of the prizes, including liability for personal injury, death, damages, or loss.

Additionally, entrants agree to release and hold harmless social media outlets such as: Facebook, Instagram, Twitter, and YouTube from and against any claims arising out of or in conjunction with the giveaway or receipt or use of any prize. Further, entrants acknowledge that this giveaway is in no way sponsored by, endorsed by, or administered by, or associated with any other third party.

The winner(s) agrees to assume all liability activity with prize, and commits to follow all safety guidelines, product use instructions, and have required parental guidance and permission.

11. Winner’s List:

After July 15, 2019, you may obtain the names of the prize winners by visiting the website.

13. Elimination:

Sponsor will be the judge of eliminating or disqualifying any entries for the following reason:

Any disputes arising out of or related to these rules shall be resolved by binding arbitration in Idaho under Idaho law. You shall indemnify, defend and hold Sponsor harmless from and against any liability to which Sponsor may be exposed as a result of your failure to abide by these giveaway rules.
